Terms of Service

Welcome to Diago ("we," "us," "our"). By using this website and service (the "Service"), you agree to the following terms. If you do not agree, please do not use the Service.

1. What Diago Is

Diago uses artificial intelligence (including third-party AI models) to provide general information and suggestions about possible vehicle problems based on the description, photos, or video you provide. Diago is an informational tool only.

2. Not Professional Advice — Disclaimer of Liability

Diago is not a substitute for inspection or diagnosis by a qualified, licensed mechanic. The AI-generated diagnoses, repair steps, cost estimates, urgency ratings, and OBD-II code suggestions are estimates only and may be incomplete, inaccurate, or unsuitable for your specific vehicle or situation.

  • You should always have a qualified mechanic inspect any safety-related issue (brakes, steering, suspension, airbags, fuel system, electrical) before driving or attempting any repair.
  • Any do-it-yourself repair steps shown are general guidance. Working on vehicles carries inherent risk of injury or property damage. Perform repairs only if you have the skill, tools, and judgment to do so safely.
  • We make no warranty, express or implied, regarding the accuracy, completeness, or reliability of any output from the Service.
  • To the fullest extent permitted by law, Diago and its owners/operators are not liable for any injury, death, vehicle damage, property damage, financial loss, or other harm arising from your use of, or reliance on, information provided by the Service.

You use the Service entirely at your own risk.

3. Accounts, Free Usage & Subscriptions

Diago offers a limited number of free diagnoses per browser/session. Continued use beyond that limit requires a paid subscription, billed on a recurring basis through our payment processor, Stripe. By subscribing, you authorize recurring charges until you cancel. You can cancel anytime; cancellation stops future billing but does not refund the current billing period unless required by law.

4. Acceptable Use

You agree not to misuse the Service, including: attempting to break or circumvent the free-usage limits or payment system, uploading unlawful or harmful content, or using the Service to harass others or violate any law.

5. Content You Submit

You retain ownership of any photos, videos, or descriptions you submit. By submitting them, you grant us a limited license to process that content (including via third-party AI providers) solely to generate your diagnosis. Do not upload content you do not have the right to share.

6. Third-Party AI Providers

The Service sends portions of your submission to third-party AI providers (including Anthropic, OpenAI, and Google) to generate diagnostic output. Your use of the Service is also subject to those providers' own terms regarding the processing of submitted data.

7. No Warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, Diago's total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 3 months preceding the claim, or $50, whichever is greater.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
